Primary Blog/Friendly Fire: How a Father's Generosity Can Strip His Disabled Child's Benefits

Here's a trap that catches loving, diligent, responsible fathers - the ones who actually did the planning:

You buy a financial product - an annuity, a life policy, a savings plan - and you name your disabled child as the beneficiary. You die a hero. The money lands.

And the money disqualifies your child from SSI and Medicaid.

Means-tested benefits look at what your child owns and receives. Assets or income landing directly in a disabled child's name - even from the grave, even from love - can put them over the resource limits, and the programs that pay for their care, therapies, and coverage can shut off. Your child can burn through your legacy replacing benefits they used to receive for free, and then be left with neither.

The general principle (this is education, not advice - the details are state-specific and person-specific): money meant for a disabled child's future usually should not be aimed at the child. It's aimed at a structure - typically a special needs trust - that holds and spends for the child's benefit without ever being the child's countable asset. The product isn't the plan. The architecture is the plan, and products are just bricks placed inside it.

This is Supply Lines - wall #3 of the Fortress. It's the one wall you cannot see is missing until it fails, because everything looks generous and responsible right up until the letter from Social Security arrives.

Three questions to ask before any dollar is pointed at your child:

1. Is my child now, or possibly ever, on means-tested benefits (SSI, Medicaid, waivers)?

2. Does this money land in my child's name, or in a structure built to protect them?

3. Who told me this was safe - and do they understand special-needs benefit rules, or just the product they're describing?
